Releasing Shipments from Automatic FDA Detention

Why will a Product be Detained?

FDA will detain a food product that are not safe for the US population.  This could include:

  • Products that contain unsafe substances (i.e. above level traces of pesticides or salmonella)
  • Unapproved drugs
  • Food products manufactured in an unsanitary plant or
  • Misbranded products that contain misleading information.

Why will FDA Automatically Detain a Product?

Sometimes, FDA will automatically detain a shipment that violated FDA rules. After discovering a violation, FDA may place the product on an Import Alert.  FDA will automatically place all future shipments of that product in detention regardless of testing or examination.  When a shipment of eggs contains traces of salmonella, for example, FDA may add the supplier or all eggs from that region to Import Alert. Without ever testing the product, FDA will automatically detain all future egg shipments from that supplier.  In a sense, FDA considers the importer “guilty until proven innocent.”  The importer must determine how to remove their shipment from detention and future shipments from Import Alert.
